we start out with developing news all eyes back on the stock market today after three straight days of triple-digit losses for the dow. the nasdaq also under new pressure this morning as well. scott mcgrew joins us now. the reality is even the most successful company in the country has disappointed investors. >> apple there. the biggest stock on the nasdaq index, that company stock fell 5% in after hours trading after the company announced sales of its iphone 4s fell short and seeing slower growth in europe. here's your overnight number. apple shares fell well under $600 a share. down a whopping 28. apple the most important stock on the nasdaq. the nasdaq is weighted, apple is the heaviest. cisco is on the nasdaq index and it's part of the dow 30 industrials and it has investors worried as well. a day ago one of its little

competitors spooked the company by moving into cisco's business. we'll get more perspective to these numbers and take a look at the shocker from netflix as well coming up in just a little bit. scott, thank you very much. we have an update to some breaking news in southern california where people were bracing for some after shocks after a moderate early morning quake. when you sit on top of it it doesn't feel moderate. magnitude 3.7 quake striking two miles from marina delray, south of santa monica. we can tell you so far no reports of any injuries. the usgs says that quake may have felt stronger than it kwully was because of it's shallow yeppy center. >> a car with four children inside peppered with bullets after someone started shooting on interstate 80. we go live to hercules for more. two people were hit by that gunfire? >> reporter: that's right. the ages of the two victims they

were driving on 80 east here in hercules when they were shot. a 24-year-old man and a 24-year-old woman. now this is where they ended up, at a 76 gas station. they actually drove up here. someone who works at the gas station told us off camera someone ran into the store at 11:00 last night and shouted someone has been shot. call 911. the victim's car was parked in front. three young kids in the back seat were unharmed. the man and woman sitting in the passenger seat had been shot. the gas station attendant said he was hit in the hand, the woman in the left stomach area and her leg. the attendant counted six bullet holes in the white pontiac. hercules police telling you that the couple was driving just past when someone drove several shots. the driver lost control and spun out on the shoulder. police are searching for the gunman who is still on the loose. >> it's shocking because this

area we really don't have no shooting and that type of thing around here. >> reporter: it happened as they were driving on 80. >> that's even more shocking. it could be something personal or gang-related. you never know. >> reporter: chp tells us someone called 911 to report a man was walking on 80 east causing drivers to stwoefr avoid hitting him. unclear who it was. it may have been someone in that targeted car. hercules police did look for evidence. they closed the stretch of 80 around willow avenue for 20 minutes but reopened by midnight. three young kids in the back seat, shaken up. they are hoping witnesses will step forward to move this case forward. >> an elderly psychiatrist accused of molesting boys during exams could be released from a state hospital today within

hours a judge is expected to decide if 79-year-old william ayres can be released from napa state hospital. an attorney for ayres said the former psychiatrist is just too sick mentally and physically to remain hospitalized. if released ayres could be sent to an unlocked senior facility or he could be let out for outpatient treatment. ayres is accused of molesting nine boys between 1991 and 1996 at a san mateo office. a 2009 trial against ayres ended in a hung jury. in marin county a suspected serial killer is questioning dna evidence that links him to a murder victim. the 78-year-old joseph naso want as forensic expert to check out the information here. he wants an expert for the defense to physically examine dna evidence founded on a murdered woman's pantyhose. he's accused of killing four women in the 1970s and 1990s.

he's acting as his own attorney. >> this morning heartbreak and anguish continues in colorado as families plan for funeral services for the 12 people killed in a movie theater massacre. today leanne gregg joins us in aurora, colorado. the man accused in that killing spree still in solitary confinement this morning. >> reporter: he still is in solitary confinement and his formal charges will be announced on monday. and also while he's waiting for that to happen the investigation is continuing. the authorities were back at the crime scene today, both of them, at the theater and at his apartment. they were looking for all kind of evidence, collecting and documents. they also plan to talk to people who know holmes and so look through records at the medical center where he was a ph.d. student. now across the street from the theater the makeshift memorial is growing. the emotions there are raw.

even among the people who didn't know the victims. they talk about feelings of sadness and of being overwhelmed by tragedy. among them the star of batman, christian bale who went to the site and laid flowers with his wife by his side. he made the trip unannounced. on a positive a victim shooting fund is at $2 million and climbing. warner brothers, the studio that produced the batman film made a major contribution. that's the latest from here in aurora. >> wish the best for them. thank you. new this morning a santa clara probation officer is recovering after a self-inflicted gunshot wound. it happened on highway 17 in santa cruz when officers from the san jose police and chp tracked down a suspect wanted on weapons violation. at this point it's still not clear exactly what happened but we're being told somehow a

probation officer's gun accidentally went off hitting him right in the upper leg. that probation officer was airlifted to a local hospital to be treated for nonlife threatening injuries. the suspect was arrested without incident. 5:08 this morning thieves have created a big stink for the upcoming gilroy garlic festival. we have an update this morning on the thousands of dollars worth of tickets that have been stolen. good morning, bob. >> reporter: good morning. someone has stolen 1,000 tickets to the gilroy garlic festival that will take place here over the weekend. 1,000 tickets worth $12,500. what these people have started to do is start selling them on craigslist and facebook. so the festival is warning people if you have bought any of those tickets, they will not be honored at the gate. ticket takers will check the serial numbers.

the soldieren adult tickets are numbered 05,0001 to 050500. if you present any of those tickets with numbers on them you will be asked to purchase new tickets which are $17 for adult, 8 for kids. let's say someone decides not to pay up again and leaves the event. that could mean lost revenue. that loss could trickle down to the nonprofits and charities that the festival helps. groups like the gilroy gator swim club. >> any lost revenue greatly hurts. obviously we need to rent the pool here. just to be up and running we really depend on the garlic festival money. that's our number one money maker over the entire year. >> reporter: whoever took these tickets stole them from the festival offices either in june or early july. there has been no arrests but people running the festival do

p.m. that's the extreme east bay. the hottest city across the bay, livermore. bay side, struggling to break out of the 50s. heat wave on the way. we'll check your drive and here's mike. >> a smooth drive across the bay. crossing the dunbarton bridge, construction, eastbound away from the peninsula. on the peninsula on the left side a disabled vehicle northbound 101 right around marsh. that might take you down a lane. no slowing for either of these incidents because of traffic volume is still light. further south we have construction that's now clearing southbound 85 from 237 all the way down mountain view into can you -- cupertino. no problem on the northbound routes. a call out to gilroy garlic festival that starts friday, staging and preparing right now.

friday's olympic ceremony, the opening olympic ceremony for the games. so close we can smell it. now even though the opening ceremony is still days away the olympic competition is getting started today. >> team usa will play its first olympic game this morning against france. today's game will be played in glasgow, scotland, only scottish venue used during the games. only time team usa has a shot to play in london if they make it to the gold medal game. >> team usa opens up the 2012 london games against france this morning. the game will be played at the famed hampton park in glasgow, scotland which is the only scottish venue to be used during the olympic games. only time team usa has a shot at playing in london is if they make that gold medal game. the team won't be able to attend

friday's opening ceremony because they actually have a game against colombia the very next afternoon. so here's a question. why is soccer getting an early start? we asked ourselves the very same question and here's the scoop for you. turns out soccer is one of two olympic sports that get that early start. women's soccer starts out today. men's soccer starts tomorrow. archery starts up on friday. the olympic committee says the extra days are necessary for soccer and archery to make sure to deept leets from wearing themselves out during a big time slaft competition. today's women's soccer match between team usa and france kicks off 9:00 our time. and will be covered on nbc sports network and the soccer channel. >> first security at the london games now with two days to go the worry is traffic. >> reporter: first of all i can

tell you ron is not stuck in traffic he's mingling with the athletes. you could say london's olympic traffic nightmare has begun. what's called the games lanes are now open. they opened today during the morning rush hour in london. the lanes are for olympic vips and they stretch for 30 miles. it's causing severe backups. commuters hoping to beat these delays by taking public transit are not faring any better. now our own olympic tourist nbc bay area raj mathai got a few words with an athlete. she's worried about her wardrobe. >> so excited although i'm paranoid as can be about what to wear to the opening ceremonies to sit in the first lady's delegation because, you know,

hours dropping. scott mcgrew, he's scratching his head. >> reporter: apple said exactly what we said they would say. we were talking about thist this exact time yesterday. apple said it sold far fewer iphone 4ss than investors had hoped. that's because people are waiting to buy the iphone 5. apple never confirmed the existence of the iphone 5 but it's coming. shares fell 5% right after the news. apple missed estimates for only the second time in the company's history and that's serious business. though there are two kinds of estimates what analysts are paid to predict, the street estimate apple missed that. what the company estimates and apple was just about right on. little secret. nobody pays attention to apple's estimates because the apple is conservative so they are worthless numbers. lost in all this apple panic is the fact that the company sold a record number of ipads. 17 million of them. 84% sales increase.

and smooth traffic right now. got that all in store for you ahead on this wednesday, july 25th, "today in the bay." good wednesday morning, everybody. very happy you can join us. time is 5:30. i'm jon kelley. >> police are searching for a gunman who shot two people. it happened on highway 80 near hercules. today stephanie chuang is live in hercules and joins us with the very latest. >> reporter: good morning. we're behind the willow avenue off-ramp. this is where the victims came to this gas station after two people in the car were shot. the car ended up here. a woman and a man hurt. in the back seat another man and three young kids unharmed. the two victims are both 24

years old. they lost control after pinole valley road when somebody else on 80 east shot at their white pontiac. six bullet holes were on the driver's rear door. she saw the man shot for a gunshot to his hand and the woman bleeding from her left stomach area and leg. police are on the search for the gunman. some residents say hearing gunfire in the city is nothing new. >> this is like, i said, this is a pretty safe area here. i mean, but you always hear gun shots and everything. at least where i live. i live in the old part of town. >> investigators closed a stretch of 80 east near willow avenue for about 20 minutes to look for evidence. hercules police have taken over the investigation. they are hoping someone who was driving on 80 east between pinole valley rode and willow avenue saw something again. they are urged to call

investigators. for now live in hercules, stephanie chuang, "today in the bay." >> more trouble for the san francisco sheriff's department. lieutenant calvary reese be arraigned on assault charges. he was arrested july 19. ross mirkarimi is fighting to keep his job as sheriff. ed lee removed ross mirkarimi from office after ross mirkarimi admitted to bruising his wife's arm. an ethics panel have yet to decide whether ross mirkarimi should keep his job. >> the water war will heat up in sacramento today. governor brown wants to install two huge pipes beneath the bay delta to carry water from northern to southern california. constant pumping has damaged the delta's eco system and another concern is the fragile levee surrounding the delta. supporters say the proposed

pipes would be more reliable in an earthquake and less harmful to the environment. opponents worry the pipes will only increase the strain allowing more water to be diverted away from the delta. governor brown and opponenting will hold duelling press conferences today in sacramento arguing their points. a financial scandal involving a states parks department may be bigger than first thought. top finance officials say tens of billions of dollars in so-called special funds are unaccounted for in many other departments. special funds are those which mostly come from user fees. now auditors say the departments were supposed to report them but lawmakers say no one has been checking to make sure that's actually being done. the scandal first broke open after the discovery of millions of dollars in hidden parks department accounts. here's something you don't hear every day on a college campus, watch out for mountain lions. one of the big cats was spotted off the uc berkeley campus. >> saw a mother, there two cubs

and then right up this walkway i saw a large male. >> he works the graveyard shift as a security guard on the campus. he's had several close encounters with mountain lions recently and now a cougar and her cubs may be living near the intersection of university drive. hikers and students are urged to avoid trails between dusk and dawn when mountain lions do their hunting. this morning local charities feeling burned after somebody stole more than $10,000 worth of tickets for the upcoming gilroy garlic festival. bob redell is live in gilroy and has an update. good morning. >> reporter: good morning. you know at first organizers for the gilroy garlic festival were hoping tickets had disappeared from their office. but when they started showing up recently for sale on craigslist and facebook, organizers

welcome back, everyone. good wednesday morning to you. live look outside overlooking san francisco. you can make out the transamerica pyramid. 5:41. >> now to decision 2012. this morning no shocker more mud slinging on the campaign trail. >> president obama and mitt romney once again sharpening their attacks and it's showing in the polls. brian mooar has a look at the new poll that proves each candidate has taken a little bit of a beating. good morning. >> reporter: hi. it's almost as if we're standing on the sidelines yelling fight, fight, fight and quietly whispering oh, they should stop it, it's terrible. let's look at the latest poll numbers. both candidates getting hit. president obama 43% negative, that is his second lowest

number. nbc news "wall street journal" poll. mitt romney his negatives 40%. that is his poorest number yet. this is at a time, of course, that's well before the conventions. but mitt romney is trying to introduce himself to the american people and right now 46% of the people in this poll say they to not like mitt romney personally. that's compared to 31% for president obama. but not only do 46% say they don't like romney, his negatives outaway his positives. he's in a net negative position, under water in terms of likability and support. this is a bad position to be in but it's an unprecedented position. never in modern times has a republican presumptive candidate been upside down like this going into the convention. >> all right. interesting stuff. brian mooar thank you very much from washington, d.c. back here in the bay area protecting both presidential candidates at the very same time may have caused more headaches than expected for local law enforcement. this morning the chronicle

reports san francisco police at the last minute had to switch gears pulling officers that were assigned to republican candidate mitt romney in order to help cover president obama's much larger motorcade. in oakland the city brought in 75 sheriff deputies to help deal with the president's event. earlier this week marked the first time both candidates were in the bay area at the same time. >> 5:43. the laws are hazy but the decision is clear. nearly 800 los angeles pot clubs have been banned. . l.a. city council voted late last night to ban all marijuana clubs pending further clarification from the california supreme court. all of the affected clubs have been ordered to shut down immediately. the dispenaries that continue comply can face legal action. for only the second time in

the company's history this one is a shocker, apple has actually missed profit estimates. the stock was just crushed in after hour trading overnight following well under $600 a share and this morning scott mcgrew has a word for that. >> reporter: that's a sale. i can't give you specific stock advice. shares of the most successful company in america much lower than they were yesterday. shares in apple fell as much as 5% after the company announced slower iphone sales. the company only sold, only 26 million iphones in the past three months and made just $35 billion in sales. what apple made in sales not profit admittedly but just sales in the last 12 weeks would buy them two yahoo! lock stock and barrel or seven aircraft carers not including the planes or the

beautiful start here but you can see those clouds are lowering, thickening up. that marine area is deep at 2,000 feet. for us that means a cooler day by five to ten degrees. from yesterday's highs, most significant cooling will take place right along the coastline. this is san jose this morning seeing low clouds tart to make their way past the santa cruz mountains. checking mostly cloudy to partly cloudy sky from the east bay to the south bay. your temperatures this morning are really comfortable, 56 degrees in fairfield. high pressure finally going to take a hike to the south, weakening significantly today, allowing cool air to move through the bay area. more clouds to start you out tomorrow means a cooler day. hard to break into the 80s in some cities for tomorrow. this is where we're looking towards today. 84 degrees in livermore. 77 -- you can't beat that. great hiking weather.

the water. fortunately that trainer survived. it happened over several minutes. the attack happened back in 2006 but just released. seaworld is being investigated for endangering its trainers nationwide. you may recall four years after that attack a killer whale actually killed a seaworld trainer in orlando. >> scary stuff. overnight a rodeo bull near sacramento found himself in a very tight spot. the bull, you see him there. he fell right into an irrigation well and then got stuck about seven feet of water there in that well in fulsom. rescue crew workers -- not easy had to work overnight to finally free the big guy. did not look comfortable. they have no idea how this guy, huge, 2,000 pounds, how he got in the well. they think he got spooked.

welcome back, everybody. if you didn't have the pleasure of going over to london for the olympic games, don't worry about it. opening ceremony of the olympic games coming up very soon. >> we're just a little more than two days away from friday's big event. some olympic sports can't wait. >> the u.s. women's soccer team starting its quest for another gold medal this morning. coming up at 9:00 a.m. in a match against france. team usa hoping for a repeat performance on that gold medal podium. the team took beijing by storm back in 2008. that was spectacular to watch. they beat brazil in overtime 1-0. that gold medal was the third for the united states in soccer, women's soccer after title i of the 2004 athens olympics and 1996 plant games, first olympic tournament in women's soccer. this year team usa women's soccer team loaded up with athletes from the bay area.

four of them played their college ball here. nicole barnhardt, rachel buehler and kellie o'hara was voted soccer's best player and alex morgan is a cal golden bear who at 11 years old is the youngest member of team usa. the ladies soccer team and the other athletes are room mates, well more or less, they all live in that same village and getting a closer look where they are living in london. we have more on the growing anticipation for the london olympic games. i know you're pumped up. >> i am. two days away. athletes are staying within the olympic village in their own residential apartments. more than 2800 apartments are in place. here's a look at them for about 17,000 athletes and officials

during the games. inside look at this. pretty basic rooms with single beds. of course also a gym, no surprise there. and they need to fuel up with their carbs and protein. a dining hall, 60,000 meals will be served. there's a rec area with a pool hall, video games and live music every night to give it even more of a town feel the olympic village even has its own mayor. >> one team to celebrate their similarities rather than the differences. >> okay. after the games if you're wondering what's going to happen with the village, officials say it's going to be converted into 3600 apartments, most of them will be offered as affordable housing. coming up, i'll show you what our own raj mathai is up to across the pond.
